Tunbridge Wells - Period office building - Tenant

A fine listed building converted to offices, close to the commercial heart of the town and overlooking the common. The tenant was served with a substantial schedule of Dilapidations on termination of the lease.

It had to be conceded that the tenant had not fully complied with his repairing obligations under the repairing covenants of the lease. However the property remained in good tenantable repair and condition.

The discussion with the landlord's surveyor therefore turned on whether actual financial loss had occurred as a result of the tenant's breach and an appropriate reduced settlement finally agreed.
